BURNETT COUNTY -- The Court has sentenced all three people charged in a Burnett County burglary case during which the suspect vehicle crashed while attempting to make a getaway from the scene of the burglary.
Criminal charges were filed against two men and one woman in Burnett County Circuit Court after law enforcement responded to a report of a burglary which culminated with the suspect vehicle crashing as it attempted to leave the scene.
The property owner reported the suspected burglary to law enforcement, stating that as he approached his property, a vehicle was pulling out of the driveway and it appeared that the vehicle was attempting to strike the property owner’s vehicle.
The vehicle then crashed and rolled just west of the address where the burglary occurred. At the site of the vehicle crash, the vehicle’s rear window was open and law enforcement located numerous items near the vehicle which were identified by the property owner as belonging to him.
Three people were located in the vehicle that crashed: Trent Sutherland, age 28; Scott Capistrant, age 29; and Paige Hom, age 20. All three were taken into custody, and charges were later filed against all three.
Paige Hom
Hom was charged with Class F Felony Burglary of a Building or Dwelling (Party to a Crime); Misdemeanor Criminal Damage to Property (Party to a Crime); Misdemeanor Receiving Stolen Property (Party to a Crime).
At a hearing on Match 18, 2022, the Hon. John Anderson found Hom guilty of Misdemeanor Receiving Stolen Property (Party to a Crime). The remaining charges against Hom were dismissed but read in. The victim made a statement to the Court. The District Attorney and Hom’s defense attorney asked the Court to accept their agreement. Hom declined to make a statement to the Court.
Judge Anderson ordered Hom to serve a withheld sentence with 1 year of probation.
Conditions of probation will prohibit Hom from having any contact with the victim or the victim's property.
Trent Sutherland
Sutherland was charged with Class F Felony Burglary of a Building or Dwelling (Party to a Crime); Misdemeanor Criminal Damage to Property (Party to a Crime); Misdemeanor Receiving Stolen Property (Party to a Crime); and 3 charges of Misdemeanor Bail Jumping. Charges of Misdemeanor Neglecting a Child; Misdemeanor Possession of Synthetic Cannabinoid; Misdemeanor Possess Drug Paraphernalia; Misdemeanor Bail Jumping; Misdemeanor Battery; and Misdemeanor Disorderly Conduct are also filed against Sutherland in three additional Burnett County Circuit Court cases.
At a hearing in April 2021, the Hon. Melissia Mogen accepted a proposed agreement from the District Attorney and Sutherland’s defense attorney and ordered Sutherland to serve a withheld sentence with 2 years of probation on convictions for Trespass to Dwelling, Misdemeanor Bail Jump, and Battery. Sutherland also received a sentence of 30 days confinement in jail for a conviction of Possession of Drug Paraphernalia.
Conditions of probation will require Sutherland to pay costs and fees, comply with regular drug testing, and programming recommended by the Department of Corrections. The remaining charges against Sutherland were dismissed but read in.
Scott Capistrant
Capistrant was charged with Class F Felony Burglary of a Building or Dwelling (Party to a Crime); Misdemeanor Criminal Damage to Property (Party to a Crime); Misdemeanor Receiving Stolen Property (Party to a Crime).
At a hearing in April 2021, the Hon. Melissia Mogen accepted a proposed plea agreement from the District Attorney and Capistrant’s defense attorney. Judge Mogen ordered Capistrant to serve a withheld sentence with 1 year of probation on a conviction for Misdemeanor Receiving Stolen Property (Party to a Crime).
Conditions of probation will require Capistrant to comply with regular drug testing and follow the recommendations of a mental health specialist. Capistrant is prohibited from using or possessing illegal drugs, substances, or paraphernalia.
The Court also ordered that the three shall be responsible for paying restitution totaling nearly $11,000.
