Man Found NGI On Charges From Attack On 77-Year-Old Person In Polk County

POLK COUNTY -- The Court has found a man Not Guilty By Reason Of Mental Defect Or Disease (NGI) on charges stemming from an attack on a 77-year-old person in Polk County in September 2020.

DrydenWire published a press release from the Polk County Sheriff’s Office on September 28, 2020, that stated that Duane Smith, Jr. had been arrested following law enforcement’s investigation into an attack on a 77-year-old person.

The victim, who sustained blunt force and edged weapon wounds, was transported for medical care and was in stable condition following the incident.

The attacker, identified as Duane, fled the scene, but was located a short time later and taken into custody without incident.

Online circuit court records show that charges of Attempted 1st Degree Intentional Homicide; Aggravated Battery; and Bail Jumping were filed against Duane. Records also indicate that Duane has remained in custody on a $100,000 cash bond since he was taken into custody following the incident.

At a hearing on June 15, 2021, the Court found Duane NGI on a reduced charge of 1st Degree Reckless Injury. The remaining charges against him were dismissed but read in. Duane will have a doctor evaluation followed by a recommendation from the doctor to the Courts to determine his committed location.
