Deputies Respond to Report of Person Passed Out in Car

BURNETT COUNTY -- Charges of 5th Offense Operating While Intoxicated and Possession of Marijuana have been filed against a Frederic, WI man following an investigation into an intoxicated person in a parked vehicle.

Shortly after 6:30p on September 23, 2018, Burnett County Sheriff’s Deputies responded to a report of an intoxicated person slumped over in a parked vehicle on Devils Lake Road east of Gables Road in Burnett County, WI.

When the Deputies responded to the scene, they saw a man in the driver’s seat of the vehicle who was later identified as Dixon Thayer, of Frederic, WI. The Deputies attempted to speak to Dixon, however, he just looked at them and then slumped over again into the seat. Dixon did ultimately respond to the Deputies, stating that he had driven there from Danbury and that he had “a lot” to drink that day. Upon being asked how much he had to drink, Dixon said, “it doesn’t matter, you’re going to take me to jail.”

When asked to exit the vehicle, Dixon stated “no” and tried to move away from the Deputies. The Deputies attempted to assist Dixon out of the vehicle, but he resisted their efforts, pulling away from them. After successfully getting Dixon out of the vehicle, he was placed under arrest.

The criminal complaint goes on to state that Deputies also found a bag containing a green leafy material suspected to be marijuana, as well as a pipe for smoking marijuana.

Dixon was transported to Burnett Medical Center. When asked if he would consent to a blood draw, Dixon told the Deputies, “do whatever you want”. After the nurse drew a sample of his blood, Dixon went on to say that he “smokes pot a lot” and that it would be evident in his blood. The results of the testing on Dixon’s blood are not known to DrydenWire.com at this time.

According to the criminal complaint, Dixon was previously convicted for OWI on April 26, 1991, in Langlade County, WI; on January 29, 1991, in Marathon County, WI; on November 2, 1998, in Lincoln County, WI; and April 23, 2012,  in Lincoln County, WI.

Online circuit court records show that Dixon was placed on a $1,000 signature bail bond at a hearing on October, with conditions that he maintains absolute sobriety. Dixon is also prohibited from entering any establishments whose primary purposes are for the sale of alcohol. The Court also ordered that he be subject to random testing for the presence of substances.

Dixon is charged with Class G Felony Operating While Intoxicated-5th Offense, Misdemeanor Possession of THC (Marijuana), Misdemeanor Possession of Drug Paraphernalia, and Misdemeanor Resisting an Officer. He scheduled to make an initial appearance later this month on these charges.

Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
