DrydenWire.com previously reported that McBain was charged after Sawyer County Law Enforcement received a report that McBain had sexually assaulted a teenaged female.

The criminal complaint states that the teenaged female had communicated with McBain via social media, agreeing to meet him. The criminal complaint filed against McBain states that he forcefully sexually assaulted the female. According to the criminal complaint, after the assault, McBain told the female, “What happens in the truck, stays in the truck”.

McBain was charged with Class B Felony 1st Degree Child Sexual Assault - Contact With Child Under Age of 16 - By Use or Threat of Force or Violence; Class D Felony Child Enticement; and Class I Felony Exposing Genitals.

Online circuit court records show that at a hearing on April 23, 2019, the Court accepted pleas of No Contest from McBain to charges of Class C Felony 2nd Degree Sexual Assault of Child, and two charges of Misdemeanor Intentionally Contribute to Delinquency of Minor. Details regarding the amended charges were not included in the online circuit court record.

Regarding McBain’s felony charge, the Court accepted a 3 year Deferred Agreement; if McBain successfully completes all conditions of the agreement, the felony charge will be dismissed. On the two misdemeanor convictions, the Court ordered a withheld sentence, 2 years of probation,  30 days county jail, and 240 hours of community service. McBain was also ordered to undergo any counseling that the Department of Corrections may impose.
