BURNETT COUNTY — A Danbury, WI man has been sentenced in Burnett County Circuit Court regarding an incident that involved a firearm.
DrydenWire.com previously reported in May 2018 that Michael Benjamin was facing felony charges after law enforcement responded to a report of shots fired.
Officers located shell casings on the ground near the residence, and Benjamin can be seen on surveillance video waving a gun around ad pointing it at another individual according to a criminal complaint filed against Benjamin.
Charges of Class F Felony 1st Degree Recklessly Endangering Safety, under circumstances which show utter disregard for human life, and Misdemeanor Disorderly Conduct with Use of a Dangerous Weapon were filed against Benjamin.
According to online circuit court records, at a recent court hearing, the Court sentenced Benjamin on his conviction for an amended charge of Class G Felony 2nd Degree Recklessly Endangering Safety and a conviction of Misdemeanor Possession of THC (Marijuana) filed against him in a separate case. Remaining charges of Misdemeanor Disorderly Conduct with Use of a Dangerous Weapon and Misdemeanor Possession of Drug Paraphernalia were dismissed but read in.

The Court ordered a withheld sentence of 2 years with probation and conditional jail time up to 90 days. If Benjamin should complete specific requirements of his probation within 45 days, the Court will reduce the conditional jail time to 20 days.
Conditions of Benjamin’s probation will also require him to maintain gainful employment and obtain his GED.
