Group Home Employee Charged With Sexual Assaulting Adult Resident

WASHBURN COUNTY -- A criminal complaint has been filed in Washburn County Circuit Court alleging that a Spooner, WI woman sexually assaulted a resident of an adult group home while employed there.

In August 2020, the Washburn County Sheriff’s Office was dispatched on a report that an employee of an adult group home was having sexual relations with a resident of the group home who was in their early 20’s.

The employee suspected of committing the sexual assault was identified as Kristy Gilbert, 27, of Spooner, WI. GIlbert had started working at the group home on July 27, 2020, according to the criminal complaint.

Investigators spoke with employees and supervisors of the group home and were advised that there had been concerns about Gilbert’s behavior and conduct toward the victim. Gilbert allegedly showed favoritism to the victim and had been observed exiting a bathroom in the residence immediately after the victim exited the same bathroom.

When interviewed, the victim told investigators that Gilbert had sexual contact with the victim on more than one occasion.

Gilbert initially denied the allegations of sexual contact when Investigators interviewed her; stating that she had noticed the victim being pushy and that the victim had asked her to engage in sexual activity, but that Gilbert had said no and attempted to redirect the victim.

Later during her interview with Law Enforcement, Gilbert allegedly admitted that she had sexual contact with the victim on at least two occasions; once outside the residence, and once inside a bathroom in the residence.

Investigators made contact with a Social Worker for the victim, who advised that the victim is considered a vulnerable adult.

At a hearing on August 19, 2020, the Court placed Gilbert on a $5,000 signature bond with conditions that she has no contact with the victim, any group home, or any vulnerable adult.

On October 9, 2020, a criminal complaint was filed charging Gilbert with Class C Felony Second Degree Sexual Assault. If convicted as charged, Gilbert faces a possible maximum penalty of imprisonment for 40 years.

Gilbert is scheduled to have an Initial Appearance on October 26, 2020, regarding her criminal charges.
