BURNETT COUNTY (DrydenWire) - A case that was filed against James Robert Sergi Brown following a shots fired incident in Burnett County on July 2, 2023, has been dismissed.
James was arrested following an intense situation during which he was accused of pointing a firearm at emergency personnel, and shots were fired by law enforcement.
Numerous felony charges were later filed against James, and the case against him was scheduled for a jury trial in April 2024.
At a court hearing on February 29, 2024, Burnett County District Attorney James Rennicke addressed a motion filed by the defense counsel for James requesting Specificity. Online court records show that the defense counsel advised that regarding the four counts of Class H Felony Battery or Threat to Judge, Prosecutor, or Law Enforcement Officer, the defense was requesting to know what specifically is a crime.
Judge Mogen heard arguments, statements, and responses from both D.A. Rennicke and the defense regarding the issue. D.A. Rennicke requested to amend charges, and the defense argued that it was not timely. Ultimately, D.A. Rennicke made a motion to dismiss the case without prejudice, and Judge Mogen granted the motion.
At the time of the writing of this post, online records do not indicate if the District Attorney intends to file any new charges.
