Court Sentences Fourth Person Charged In Sawyer Heroin Bust

SAWYER  --  The Court has sentenced four people charged criminally in Sawyer County Circuit Court following a heroin drug trafficking bust in April 2020.

DrydenWire reported on April 7, 2020, that after conducting 2 search warrants in the Village of Ojibwe, Law Enforcement had arrested two men; Darryl A. Ruwe and Richard C. Emery.

A criminal complaint filed in Sawyer County Circuit Court stated that a traffic stop on April 4, 2020, led to the search warrants after Sawyer County K9 Unit alerted on a vehicle resulting in the discovery of a package of heroin. The driver of the vehicle, Diana Ruiz, and the passenger, Jordan Carley, had obtained the heroin from Ruwe (their neighbor) and were attempting to complete a sale of the heroin with the intent of returning the money to Ruwe.

A call was placed to Ruwe requesting that he come to pick up Ruiz & Carley due to their car breaking down. Ruwe agreed to do so; and a traffic stop was conducted on his vehicle after he left his residence. Officers found a small amount of marijuana on his person.

Law Enforcement obtained search warrants for the residences of Ruwe and Carley and during the execution of those search warrants, Deputies located 39.89 grams of heroin, 2.98 grams of marijuana, items of drug paraphernalia, a large amount of cash, and a loaded .22 caliber semi-automatic handgun.

Darryl Ruwe was charged with Class D Felony Possession with Intent to Deliver Heroin (>10-50g), Repeater; Class I Felony Maintaining a Drug Trafficking Place, Repeater; Class G Felony Possession of a Firearm by a Felon, Repeater; Misdemeanor Possession of Tetrahydrocannabinols; and Misdemeanor Possession of Drug Paraphernalia.

A sentencing hearing was held on November 20, 2020, for Ruwe and the Court ordered a 12-year sentence for his conviction of Class D Felony Possession with Intent to Deliver Heroin (>10-50g), without the Repeater penalty enhancer. The remaining charges against Ruwe were dismissed but read in a hearing in September 2020.

Darryl Ruwe


Ruwe was ordered to serve 6 years of initial confinement to be followed by 6 years of extended supervision. According to online circuit court records, this sentence is to be served consecutively following an additional 18-month prison term that was ordered because Ruwe’s extended supervision was revoked on 2 prior Sawyer County Circuit Court cases following his arrest in April 2020. An additional 18 months of supervision was ordered as well on the revocation sentence. Ruwe received credit for 306 days time served on the two prior cases.

Conditions of extended supervision will require Ruwe to maintain absolute sobriety; undergo cognitive behavioral programming and any other counseling as directed by the Department of Corrections, and cooperate with random urinalysis.

Jordan Carley


Jordan Carley was charged with Class F Felony Possess w/Intent-Heroin (<=3g), Party to a Crime, Misdemeanor Possession of Tetrahydrocannabinols; and Misdemeanor Possession of Drug Paraphernalia.

Online circuit court records show that at a hearing in September 2020 the Court ordered a withheld sentence with 5 years of probation for Carley’s conviction of Class F Felony Possess w/Intent-Heroin (<=3g), Party to a Crime. The remaining charges against Carley were dismissed but read in. Carley was ordered to complete any counseling and programming deemed appropriate by his probation agent.

Richard Emery


Richard Emery was charged with Class D Felony Possession with Intent to Deliver Heroin (>10-50g), Party to a Crime.

At a hearing in July 2020, the Court accepted Emery’s plea of No Contest to an amended charge of Class I Felony Possession of Narcotic Drugs and ordered a sentence of 110 days in county jail; time already served.

Diana Ruiz


Diana Ruiz was charged with Class F Felony Possess w/Intent-Heroin (<=3g), Party to a Crime, Misdemeanor Possession of Tetrahydrocannabinols; and Misdemeanor Possession of Drug Paraphernalia.

The Court accepted a plea of No Contest from Ruiz to an amended charge of Class I Felony Possession of Narcotic Drugs at a hearing in May 2020. Ruiz received a withheld sentence with 5 years of probation. Conditions of probation will require Ruiz to complete any counseling and programming deemed appropriate by her probation agent.
