BURNETT COUNTY -- A Frederic, WI man has been ordered to serve 6 months county jail for 5th OWI conviction; eligible for electronic monitoring.
DrydenWire.com previously reported that Dixon Thayer, of Frederic, WI, was facing charges of Class G Felony Operating While Intoxicated-5th Offense, Misdemeanor Possession of THC (Marijuana), Misdemeanor Possession of Drug Paraphernalia, and Misdemeanor Resisting an Officer following an incident in which law enforcement found Thayer passed out at the wheel of a car on September 23, 2018. Thayer’s vehicle was parked on Devils Lake Road east of Gables Road in Burnett County, WI.
Deputies who responded to the scene found Thayer slumped over in the driver’s seat of the vehicle according to a criminal complaint filed in Burnett County Circuit Court. Thayer consented to an evidentiary blood draw stating that he “smokes pot a lot” and that it would be evident in his blood, according to the criminal complaint.
Online circuit court records show that at a hearing on July 30, Thayer plead guilty to a charge of Operating While Intoxicated 5th Offense. The remaining charges of Misdemeanor Possession of THC (Marijuana), Misdemeanor Possession of Drug Paraphernalia, and Misdemeanor Resisting or Obstructing an Officer were dismissed but read in for consideration in sentencing. One additional charge of 5th Offense Operating with a Prohibited Alcohol Concentration was merged in and dismissed outright upon prosecutor’s motion.
The Court ordered a sentence of 6-months county jail with eligibility for electronic monitoring. Conditions also require Thayer to undergo an Alcohol and Other Drug Assessment and follow through with any recommendations.
Thayer was also ordered to pay nearly $2,000 in fines and costs.
