Court Accepts Deferred Sentence Agreement For Woman Charged With Sexual Assault of Group Home Resident

WASHBURN COUNTY -- THe Court has accepted a deferred sentence agreement for a woman who was charged with sexually assaulting a resident of an adult group home while she was employed at the group home.

DrydenWire reported in October 2020, that charges had been filed against Kristy Gilbert, of Spooner, WI. The criminal complaint stated that Gilbert had been employed for a Washburn County adult group home and while employed had engaged in sexual activity with a resident of the group home.

Initially, Gilbert denied the allegations, however, later admitted to having sexual contact with the victim on at least two occasions. Social workers advised law enforcement that the victim was a vulnerable adult. 

Gilbert was charged with Class C Felony Second Degree Sexual Assault. Online circuit court records show that Gilbert appeared on June 9, 2021, and entered pleas of guilty to Class C Felony Second Degree Sexual Assault and two additional charges of Misdemeanor Disorderly Conduct.

The Court accepted a two-year deferred sentence agreement on the felony sexual assault charge and ordered two years of probation on the two misdemeanor convictions.

Gilbert is required to complete an Alcohol and Other Drug Assessment and maintain Absolute sobriety.

Conditions of probation also prohibit Gilbert from consuming or possessing any controlled substances unless prescribed and she is not allowed to have contact with adult facilities unless pre-approved by a Department Of Corrections agent.

Online records also show that she is ordered to pay nearly $900 in costs and fees.
