Charges Filed Against Grantsburg Man for Repeated Sexual Assault of Child

Charges have been filed in Burnett County Circuit Court against a Grantsburg, WI man following an investigation into the reported sexual assault of a juvenile.

A criminal complaint has been filed against Alan Byers, age 42, charging him with two counts of Class C Felony Repeated Sexual Assault of a Child.

According to the criminal complaint, on August 25, 2018, the Burnett County Sheriff’s Department received a report of a sexual assault involving a juvenile. Investigating officers interviewed the mother of the 7-year-old female victim. The mother stated that she was having a conversation with her daughter who was asking questions about what she would look like when she was grown up. During this conversation, the daughter stated to her mother that she knew that girls have vaginas and boys do not, because she had seen what Alan Byers has.

The mother told investigators that when she asked additional questions, her daughter indicated that it had happened more than once and that Byers had allowed the 7-year-old to touch his genitalia.

On August 27, 2018, Byers arrived at the Burnett County Sheriff’s Department voluntarily, according to the criminal complaint, and stated: “I did something bad”.

Investigators interviewed Byers who said that he was not sure how to explain why he was there, but that it started with a juvenile female pulling his pants down. Byers identified the juvenile as the same 7-year-old girl in the report received on August 25, 2018.

He went on to state that it had happened numerous times and that he also allowed the girl to touch his genitalia. When questioned, Byers said that he never touched the girl’s genitalia or had intercourse with her. He also stated that nothing had happened to any other children.

The criminal complaint goes on to state that a forensic interview was conducted with the 7-year-old girl, who confirmed what had already been told to investigators.

Online circuit court records show that Byers appeared for a bail bond hearing on August 28, 2018, at which time the Court placed him on a $2,500 cash bail bond which was posted that same day. Conditions of the bail bond prohibit Byers from having any contact with the child or with any child under the age of 16 without supervision.

Pursuant to the direction of the Wisconsin Supreme Court, as found in Supreme Court Rule 20:3.6, Trial Publicly, you are advised that a charge is merely an accusation and that a defendant is presumed innocent until and unless proven guilty.
